论文发表作为高校博士学位授予标准:理论争议、现实困境与优化策略

摘要:
高校将论文发表作为博士学位授予标准存在着权力属性界定不清、办学自主权与学生学位获得权之间的关系以及具体标准不明确等问题。在实践过程中,权力属性模糊致使针对博士生论文发表要求的司法审查依据不明;相关法律的缺位导致难以对高校设置的论文发表要求与博士学位授予挂钩的行为进行有效约束。并且,这种单一的以论文为导向的评价方式产生了诸多负面影响。基于此,在国家层面应加快完善并出台新的学位法,明晰高校学位授予标准设置权的权力属性以及程序规范。高校应依法行使设置博士学位授予标准的权力,完善多元化的学术评价方式。

Abstract:
There are problems such as unclear power attributes, tension between autonomy in running schools and students’ right to obtain degrees, and unclear specific scope and standards, when universities regard thesis publication as the standard for awarding doctoral degrees. In practice, the vague attribute of power leads to the unclear basis of judicial review of doctoral thesis publishing requirements. The absence of relevant laws makes it difficult to effectively restrict the behaviors of universities that set up the requirements for publishing papers and doctoral dissertations. Moreover, this thesis-oriented evaluation method has produced many negative effects. Based on this, at the national level, we should speed up the issue of a new degree law to clarify the power attributes and procedural norms of the right to set standards for degree awarding in universities. Universities should exercise the power to set standards for awarding doctoral degrees according to law, and improve diversified academic evaluation methods.
